Senate Joint Resolution 28 - Oregon Laws 1999

Session Law

 

      Whereas physicians and other health care professionals should not fear disciplinary action from the Board of Medical Examiners or other regulatory agencies for prescribing, dispensing and administering controlled substances, including opioid analgesics, for legitimate medical purposes in the usual course of professional practice; and

      Whereas persons with pain have the right to have their pain report be believed; and

      Whereas persons with pain have the right not to be discriminated against because of age, gender, mental abilities or prior or current substance abuse history; and

      Whereas persons with pain have the right to considerate and respectful care from all health care professionals involved in the management of their pain; and

      Whereas persons with pain have the right to have the diagnosis, prognosis and treatment plan explained and discussed in an atmosphere of mutual cooperation; and

      Whereas persons with pain have the right to be informed of all complementary treatment modalities that are available for management of their pain disorder; and

      Whereas persons with pain have the right to refuse any and all treatments and to be informed of medical consequences of such refusal; and

      Whereas persons with pain have the right to request a second opinion regarding their diagnosis and treatment plan; and

      Whereas persons with pain have the right to be advised of their own responsibilities in following through with a mutually agreed upon plan of treatment; now, therefore,

 

Be It Resolved by the Legislative Assembly of the State of Oregon:

 

      That we, the members of the Seventieth Legislative Assembly, direct the Department of Human Resources and all health-related boards and commissions, and encourage health care professional organizations, to make every effort to support the rights of persons with pain and to widely distribute information regarding persons with pain to applicants, licensees and the general public.
