                             SUMMARY

introduced.

  Allows primary care clinics in medically underserved areas to
obtain reimbursement for unrecovered costs incurred in providing
medical care to uninsured lower income persons.

                        A BILL FOR AN ACT
Relating to safety-net clinics.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section:
  (a) 'Lower income' means income equal to or less than 80
percent of area median income, as determined by the Department of
Human Resources.
  (b) 'Safety-net clinic' means a not-for-profit, tax exempt or
public community based facility providing primary medical care in
a medically underserved area.
  (c) 'Unrecovered costs' means the actual direct and indirect
costs incurred by the safety-net clinic in providing services,
and fair compensation for services rendered, that the clinic has
attempted and has been unable to recover from the person
receiving the services.
  (2) The Department of Human Resources shall establish a program
to reimburse safety-net clinics for unrecovered costs associated
with providing necessary medical care to lower income persons who
lack insurance and are not covered by the Oregon Health Plan. To
qualify for reimbursement, an unrecovered cost must arise from a
provided service of the same type as a service that receives
coverage under Medicare, Medicaid or the Oregon Health Plan. If a
provided service is of the same type as a service that is covered
under Medicare, Medicaid and the Oregon Health Plan, the maximum
reimbursement for the unrecovered cost shall be the lower of the
Medicare reimbursement rate, the Medicaid reimbursement rate or
the Oregon Health Plan reimbursement rate for the service. + }
