Removes premium limitation restrictions and certain mandates
for group high-deductible health benefit plans associated with
medical savings accounts.
A BILL FOR AN ACT
Relating to medical savings accounts.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 1999 Act is added to and made
a part of ORS chapter 743. + }
SECTION 2. { + (1) As used in this section:
(a) 'High-deductible health benefit plan' means a plan
described in section 220(c)(2) of the Internal Revenue Code, as
amended and in effect on December 31, 1998.
(b) 'Medical savings account' has the meaning given that term
in ORS 316.743.
(2) Notwithstanding any other provision of law to the contrary,
a high-deductible health benefit plan that is associated with a
medical savings account and that is a group health benefit plan
is not subject to:
(a) A risk adjustment mechanism or other limitation on the
amount of premiums that may be charged with respect to the
policy; or
(b) Mandated coverage described in ORS 743.556, 743.699,
743.704, 743.706, 743.710, 743.726, 743.727, 743.728, 743.729,
743.736, 743.737, 743.745, 743.751, 743.752, 743.754, 743.760,
743.761, 743.766 or 743.767. + }
SECTION 3. { + Section 2 of this 1999 Act applies to
high-deductible health benefit plan premiums charged on or after
the effective date of this 1999 Act. + }
